What a fibromyalgia disability claim involves

Fibromyalgia produces widespread pain, exhaustion that sleep does not fix, and the cognitive fog that most people living with it find harder to work around than the pain itself. It is a recognized condition. It also has no confirmatory test, and that single fact shapes every disability claim built on it.

Your policy does not ask whether a scan can find the illness. It asks whether you can perform the duties of your occupation. Those are different questions, and keeping the claim focused on the second one is most of the work — because an insurer’s preferred argument is almost always to relitigate the first.

Fibromyalgia Claims

No test does not mean no claim

Fibromyalgia and other chronic pain conditions are refused at a higher rate than almost any other basis for a disability claim, and the stated reason is usually some version of “subjective, self-reported symptoms.”

That is a negotiating position rather than a statement of law. Canadian courts have repeatedly accepted fibromyalgia and chronic pain claims where the functional limitations were properly documented. The task is not to produce a test result that does not exist. It is to build a record of function detailed and consistent enough that the absence of a test stops being the interesting question.

Why fibromyalgia claims are contested

The objection is nearly always the same one, arriving in different words: there is nothing to see. A claim that anticipates that objection and answers it with evidence of function is in a much stronger position than one that argues about whether the diagnosis is real.

When there is no test to point to

A fibromyalgia diagnosis is made clinically — on symptom history, duration, and the exclusion of other explanations — which is a perfectly ordinary way for medicine to work and an awkward one for an insurance file. There is no image to attach.

What can be attached is specificity. Not “chronic pain,” but how long you can sit before you have to stand, how many consecutive days you manage before you lose one entirely, what time of day the cognitive symptoms make careful work impossible. Detail at that level is difficult to dismiss as vague, because it is not vague.

Building a claim on function

The strongest fibromyalgia files combine four things: a specialist assessment, usually rheumatology; a consistent treatment history showing you have pursued the condition seriously rather than simply reported it; a functional capacity evaluation where one is available; and a contemporaneous record kept by you, a pain and activity diary maintained over months.

The diary carries more weight than people expect. Kept honestly — including the better days — it demonstrates the variability that defines the condition and answers the surveillance argument before it is made. One afternoon of a person managing their groceries is not evidence of capacity to work; a year of dated entries showing what that afternoon cost is evidence of the opposite.

Our Fibromyalgia Claims
Lawsuit Process

What follows is the route from a denial letter to a resolution, and the points along it where the outcome is genuinely decided.

1

Consultation

Bring the policy, the denial letter and anything the insurer has sent you. The policy wording matters most, particularly whether the definition of disability shifts from your own occupation to any occupation after two years — the point at which a large share of chronic pain claims are terminated. The consultation is free and you will get an honest assessment, including if that assessment is that the claim is weak.

2

File your Fibromyalgia Claim

First the limitation period, which keeps running throughout an internal appeal and catches people who assumed it did not. Then the evidence: the complete clinical file, a specialist report addressing functional restrictions rather than diagnosis alone, and the employment record showing the deterioration — reduced hours, failed accommodations, the pattern of absence that preceded stopping altogether.

3

Resolution

Most claims resolve at negotiation or mediation, as reinstated monthly benefits or as a lump sum. With a fluctuating, long-term condition the choice between those two is a real decision with real trade-offs, and it deserves proper discussion rather than a quick answer. Where the insurer will not move, the file is litigated.

We are Your Fibromyalgia Claim Lawyers

Claims built on conditions that do not appear on a scan need to be built deliberately. The firm has been doing that for Ontario clients since 2003.

Results

More than $500 million recovered across the firm’s practice areas. Disability claims are taken on contingency: nothing up front, and nothing at all unless the claim succeeds.

Relationships

You deal with the lawyer on your file. Clients with fibromyalgia have usually spent years being doubted by one institution or another, and not having to make the case for the condition’s existence to their own lawyer is the baseline here. The firm works in nine languages, with interpreters where needed.

Recovery

The measure is whether the outcome funds the treatment, the pacing, and the household costs of a condition that does not resolve on a schedule. A claim that clears the mortgage but not the physiotherapy has only done half the job.

FAQS

Fibromyalgia Claim FAQs

Is fibromyalgia covered by long term disability?

It can be. Policies turn on whether you can perform your occupation, not on whether a condition shows up on imaging. Fibromyalgia has no confirmatory test, which is exactly why these claims are denied more often and why the functional evidence has to be built deliberately.

Because there is no objective test, insurers frequently characterize the condition as subjective or self-reported. That is a position, not a legal answer, and Canadian courts have accepted fibromyalgia claims where the functional limitations were properly documented.

A specialist assessment, a consistent treatment history, and a functional record: a daily activity or pain diary, a functional capacity evaluation where available, and accounts from people who see your limitations day to day.
