What a depression disability claim actually is ?
A long term disability claim for depression is a claim under an insurance policy, not a claim against a person. Either your employer’s group plan or a policy you bought yourself promises to replace part of your income if illness stops you working. Depression is an illness for that purpose, on the same terms as any other.
That last point gets contested more often than it should. Policies define disability by whether you can perform the duties of your occupation — not by whether the condition shows up on a scan. An insurer suggesting that a mental illness is somehow a weaker category of claim is describing its own preference, not the wording of the contract it wrote.
A TRUSTED RECORD
OF ADVOCACY AND RESULTS
FOR CLIENTS
A denial is a decision, not a verdict
When a long term disability claim is refused, the letter tends to read with a finality it does not actually have. A denial is a decision made by an insurance company, in its own interest, by someone who has never met you. It is not a determination by a court, and it can be appealed or litigated.
There is also a practical trap in the internal appeal process. Insurers commonly invite you to submit more information and have it reconsidered, which sounds reasonable and often is — but the limitation period for suing keeps running while you do it. People lose otherwise good claims by appealing politely for two years. Get advice on the deadline before you start that process, not after.
Why depression claims get denied
Three reasons account for most refusals: the insurer says the evidence is insufficiently objective, it points to gaps in treatment, or the file documents a diagnosis without documenting what you can no longer do. The third is the most common and the most fixable, because the information usually exists — it just was never written down in the form the policy requires.
The problem of invisible evidence
“Objective evidence” is the phrase that appears in most depression denials, and it is doing a lot of quiet work. There is no blood test for major depressive disorder. If a policy could only be satisfied by imaging, no mental health claim would ever succeed, which is plainly not what the contract says.
What can be documented is function, and consistently. Sleep, concentration, memory, the ability to be reliable at a specific time on a specific day, the ability to tolerate ordinary workplace pressure. A file that records those in detail is objective in every sense that matters — it is specific, it is dated, and it comes from more than one source.
What insurers ask for, and why
Expect requests for full clinical notes, medication history, functional questionnaires and often an independent medical examination arranged and paid for by the insurer. Some of these are legitimate parts of assessing a claim. Others are gathering material for a refusal.
Surveillance and a review of your social media are both routine, and both work on the same assumption: that a person who is genuinely disabled by depression would never be seen doing anything ordinary. That is not how the illness works, and a good day photographed is not evidence of capacity to hold down a job. Knowing which requests you have to comply with, and how to answer them accurately, is most of the value a lawyer adds at this stage.

Our Depression Claims
Lawsuit Process
Most of these claims are resolved without a courtroom. The sequence below is what happens between a denial letter and a resolution, and where the outcome is actually decided.
Consultation
Bring the policy if you have it, the denial letter, and any correspondence from the insurer. The policy wording is the single most important document, because it defines what “disabled” means for your claim — and whether the definition changes after the first two years from your own occupation to any occupation, which is the point at which many claims are cut off. The consultation is free and you will be told honestly whether the claim is worth pursuing.
File your Depression Claim
The first job is the limitation period, which is generally two years but can vary with the policy and the circumstances, and which continues to run during an internal appeal. Once that is secured, the work is evidentiary: obtaining the complete clinical file, asking treating physicians for reports that address function rather than only diagnosis, and gathering the employment record — declining attendance, changed performance reviews, the accommodations that were tried before you stopped.
Resolution
Most claims settle at negotiation or mediation, either as reinstated monthly benefits or as a lump sum buying out the policy’s future obligation. Which of those is better depends on your prognosis and your circumstances, and it is a decision worth taking time over. Where an insurer will not move, the claim is litigated. You decide whether to accept any offer.
We are Your Depression Claim Lawyers
Disability claims are argued on policy wording and proved on medical evidence. The firm has been doing both for Ontario clients since 2003.
Results
More than $500 million recovered across the firm’s practice areas, with disability claims taken on contingency. No fees up front, and no fees unless the claim succeeds — which is the only arrangement that works when the reason you need a lawyer is that your income stopped.
Relationships
You deal with the lawyer handling your file. Depression makes repeated explanation genuinely costly, and not having to start over with a new contact each time is part of the service rather than a nicety. The firm works in nine languages, with interpreters where it does not speak yours.
Recovery
The point of the claim is the monthly benefit or the settlement that replaces it — the thing that lets you keep the house and keep treating the illness instead of going back to work too early and relapsing. That is the outcome being aimed at, not a moral victory over an insurer.
Service Areas
Depression Toronto

Depression Burlington

Depression Ontario
Claims taken across Ontario, including clients whose benefits were cut off while they were still under active treatment.

“I have known Samiya Ahmad for many years and I can say, without a doubt, that she is an excellent lawyer with fantastic intuition and a genuine desire to promote the well being of her clients. In my opinion this is exactly what you should look for in a lawyer, someone with not just a degree, but rather an individual who has excellent legal skills and is able to apply them in a practical and passionate manner. In a marketplace with so many mixed messages and (unfortunately) unreliable service providers, I am glad that lawyers such as Samiya exist as an exception from the rule.”
“Like most MVA’s, litigation takes a long time. Joe and his team were great in all aspects of our representation, communication, follow ups, replies, and transparency over this extended period of time. Heaven forbid, if I did have another MVA that required a lawyer, this is the team I would choose to protect us.”
“Zayouna Law Firm is a very professional firm with kind, welcoming and understanding team. Very happy and satisfied that I have chosen them to represent me. Highly recommended.”
“Joseph and team were very professional and on top of every situation that arose. Joseph is a very kind and understanding Lawyer. We appreciate all that he did for us. Thank you is not enough for what Joseph has done for us. Once again, Thank you Joseph and team.”
Depression Claim FAQs
Does depression qualify for long term disability?
Yes. Policies define disability by your inability to perform the duties of your occupation, not by whether the condition is physical. Depression that prevents you from working qualifies on the same terms as any other illness, and insurers who suggest otherwise are describing their preference rather than the policy.
Why was my depression claim denied?
Most commonly for insufficient objective evidence, gaps in treatment, or a file that documents the diagnosis without documenting the functional restrictions. A denial is a decision by an insurer, not a determination by a court, and it can be appealed or litigated.
What evidence supports a depression claim?
Consistent treatment with a family physician, psychiatrist or psychologist, records that describe what you cannot do rather than only what you have been diagnosed with, and medication history. Employer records showing declining attendance or performance before you stopped working also help.
